The hired lawyer for Judge Emmet Sullivan filed a response to the DC District Court order in the case against Michael Flynn. [pdf available here] The DC District Court ordered Judge Sullivan to explain why he would not allow DOJ to drop charges against Michael Flynn.

Amazingly Sullivan’s lawyer says the DOJ position is essentially a dead issue and that Michael Flynn can defend himself against independent accusations by the court.

The POS Sullivan now claims Lt. General Flynn must defend himself against claims of unlawful lobbying for Turkey that were never part of the original DOJ filing before the court.

The DOJ is not playing around!

The response from the Department of Justice comes directly from the Office of the United States Solicitor General, Noel Francisco. The DOJ has responded to the DC District Court invitation to file a brief in support of intervention by the appellate court. [pdf available here]

The DOJ points out that Judge Sullivan has no standing to violate Article II and Article III of the U.S. Constitution. “The Constitution vests in the Executive Branch the power to decide when—and when not—to prosecute potential crimes,” Francisco argues.

Additionally, rules of criminal procedure “do not authorize a court to stand in the way of a dismissal the defendant does not oppose, and any other reading would violate both Article II and Article III” the DOJ writes.

Michael Flynn’s defense attorney Sidney Powell called-in to FBN with Lou Dobbs to discuss the latest filings in the case against her client.

President Trump on Monday defiantly walked out of the White House and over to the nearby damaged St. John’s Episcopal Church, imploring cities to step up efforts to end the destructive rioting.  America needs “healing not hatred, justice not chaos,” he declared.

The president’s impromptu foray to the damaged church across the street from the White House followed a national address in which he called on cities and states to implement an “overwhelming law enforcement presence” to stop violent riots after George Floyd’s death.
